By accessing and using MotoCare ("the Platform", "we", "us", or "our"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our services.

MotoCare is a digital platform that connects motorcycle owners ("Customers") with motorcycle service providers ("Service Providers" or "Shop Owners") in Cagayan de Oro City, Philippines.

2. Definitions

  • Platform: The MotoCare website, mobile application, and all related services.
  • User: Any person who accesses or uses the Platform, including Customers, Service Providers, and Administrators.
  • Customer: A registered user seeking motorcycle repair and maintenance services.
  • Service Provider/Shop Owner: A registered business entity or individual providing motorcycle repair and maintenance services.
  • Service: Any motorcycle repair, maintenance, or related service offered through the Platform.
  • Appointment: A scheduled service booking made through the Platform.
  • Walk-in Request: An unscheduled service request submitted through the Platform.

3. User Accounts and Registration

3.1 Account Creation

  • You must be at least 18 years old to create an account.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.

3.2 Customer Registration

  • Customers must provide valid personal information, including driver's license details.
  • Vehicle information must be accurate and verifiable.
  • You may register multiple vehicles under one account.

3.3 Service Provider Registration

  • Service Providers must provide valid business information, including business permits and licenses.
  • All business documents must be authentic and current.
  • Service Providers must maintain valid business permits and licenses throughout their use of the Platform.
  • We reserve the right to verify and approve Service Provider accounts before activation.

3.4 Account Suspension and Termination

  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • Accounts may be suspended for providing false information, fraudulent activity, or violation of Platform policies.
  • You may terminate your account at any time by contacting our support team.

4. Platform Services

4.1 Service Booking

  • The Platform facilitates connections between Customers and Service Providers.
  • Appointments are subject to Service Provider availability and confirmation.
  • Service Providers reserve the right to accept or decline appointment requests.
  • Walk-in requests are subject to Service Provider availability and acceptance.

4.2 Service Provision

  • Service Providers are independent entities and are solely responsible for the quality and delivery of services.
  • MotoCare does not provide, control, or guarantee the services offered by Service Providers.
  • Service Providers must provide accurate service descriptions, pricing, and time estimates.
  • Service Providers are responsible for maintaining their operating hours and availability.

4.3 Service Warranties

  • Warranties are provided by Service Providers, not by MotoCare.
  • Warranty terms and conditions are determined by individual Service Providers.
  • Customers must retain warranty documentation provided by Service Providers.
  • MotoCare is not responsible for warranty claims or disputes between Customers and Service Providers.

5. Payments and Pricing

5.1 Payment Methods

  • Payments are processed directly between Customers and Service Providers.
  • Accepted payment methods are determined by individual Service Providers.
  • MotoCare may facilitate payment processing but is not a party to payment transactions.

5.2 Pricing

  • Service Providers set their own prices for services.
  • Estimated prices provided on the Platform are subject to change based on actual service requirements.
  • Final pricing must be agreed upon between Customer and Service Provider before service commencement.
  • MotoCare does not guarantee pricing accuracy and is not responsible for pricing disputes.

5.3 Invoices

  • Service Providers may generate invoices through the Platform.
  • Invoices are official documents provided by Service Providers.
  • Customers are responsible for reviewing invoices for accuracy before payment.

6. User Conduct and Responsibilities

6.1 Prohibited Activities

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose.
  • Violate any applicable laws or regulations.
  • Infringe upon the rights of others.
  • Upload false, misleading, or fraudulent information.
  • Impersonate any person or entity.
  • Interfere with or disrupt the Platform's operation.
  • Attempt to gain unauthorized access to the Platform or other users' accounts.
  • Use automated systems to access the Platform without authorization.
  • Harass, abuse, or harm other users.
  • Post false reviews or ratings.

6.2 Customer Responsibilities

  • Provide accurate vehicle information and service requirements.
  • Arrive on time for scheduled appointments or notify Service Providers of delays.
  • Cancel appointments in a timely manner if unable to attend.
  • Pay for services rendered as agreed with Service Providers.
  • Treat Service Providers and their staff with respect.

6.3 Service Provider Responsibilities

  • Provide accurate business information and service descriptions.
  • Maintain valid business permits, licenses, and insurance.
  • Honor confirmed appointments and provide services as described.
  • Provide accurate pricing estimates and honor agreed-upon prices.
  • Maintain professional standards and quality of service.
  • Respond promptly to customer inquiries and appointment requests.
  • Update operating hours and availability regularly.
  • Issue proper invoices and warranty documentation.

7. Intellectual Property

  • All content on the Platform, including logos, text, graphics, and software, is the property of MotoCare or its licensors.
  • You may not reproduce, distribute, or create derivative works without written permission.
  • User-generated content remains the property of users but grants MotoCare a license to use, display, and distribute such content on the Platform.

8. Disclaimers and Limitations of Liability

8.1 Service Disclaimer

MotoCare acts solely as an intermediary platform connecting Customers and Service Providers. We do not:

  • Provide, control, or guarantee the quality, safety, or legality of services offered by Service Providers.
  • Endorse or recommend any specific Service Provider.
  • Verify the qualifications, licenses, or insurance of Service Providers (beyond document verification).
  • Assume responsibility for disputes between Customers and Service Providers.

8.2 Limitation of Liability

To the maximum extent permitted by law:

  • MotoCare shall not be liable for any indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount you paid to us in the past 12 months, or PHP 5,000, whichever is greater.
  • We are not liable for any damages resulting from:
    • Service quality or outcomes provided by Service Providers.
    • Disputes between Customers and Service Providers.
    • Technical failures, interruptions, or errors in the Platform.
    • Unauthorized access to your account or data.

8.3 Platform Availability

  • We do not guarantee uninterrupted or error-free operation of the Platform.
  • We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.
  • We are not liable for any losses resulting from Platform unavailability.

9. Dispute Resolution

9.1 Customer-Service Provider Disputes

  • Disputes between Customers and Service Providers should be resolved directly between the parties.
  • MotoCare may facilitate communication but is not obligated to mediate disputes.
  • We encourage parties to resolve disputes amicably and professionally.

9.2 Platform Disputes

  • Disputes regarding Platform services or these Terms shall be resolved through good faith negotiation.
  • If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Cagayan de Oro City, Philippines.
  • Philippine law shall govern these Terms and any disputes arising therefrom.

10. Privacy and Data Protection

  • Your use of the Platform is also governed by our Privacy Policy.
  • We collect, use, and protect your personal information in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173).
  • By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

11. Modifications to Terms

  • We reserve the right to modify these Terms at any time.
  • Material changes will be notified through the Platform or via email.
  • Continued use of the Platform after changes constitutes acceptance of modified Terms.
  • If you do not agree to modified Terms, you must discontinue use of the Platform.

12. Termination

12.1 Termination by User

  • You may terminate your account at any time by contacting our support team.
  • Upon termination, your access to the Platform will be immediately revoked.
  • Some information may be retained as required by law or for legitimate business purposes.

12.2 Termination by MotoCare

  • We may suspend or terminate your account for violation of these Terms.
  • We may terminate accounts that are inactive for extended periods.
  • Termination may be immediate and without prior notice for serious violations.

13. Force Majeure

MotoCare shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or internet failures.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MotoCare regarding your use of the Platform.

For Customers:

  • Account Information: Username, password (encrypted), registration status

For Service Providers/Shop Owners:

  • Business Information: Business name, owner name, business permit number, TIN number, SSS number
  • Contact Information: Email, phone numbers, business address
  • Location Information: GPS coordinates (latitude, longitude), barangay, municipality, province
  • Business Documents: Business permits, shop photos, certificates (TIN, SSS, Mayor's permit, Barangay clearance)
  • Service Information: Services offered, specializations, operating hours, pricing
  • Account Information: Username, password (encrypted), verification status

1.2 Transaction Information

  • Appointment details (date, time, service type, status)
  • Walk-in request information
  • Service records and work performed
  • Payment information (amount, method, status, invoice details)
  • Warranty information and warranty slips

1.3 Usage Information

  • Device information (IP address, browser type, operating system)
  • Usage patterns and preferences
  • Log data (access times, pages viewed, actions taken)
  • Location data (when using location-based features)

1.4 Communication Information

  • Messages and communications between users
  • Customer support inquiries and responses

2. How We Collect Information
